Where liability cannot be excluded by law, our total aggregate liability shall not exceed the fees paid by you for the specific services giving rise to the claim during the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Green Path, its affiliates, directors, officers, employees, agents, and contractors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from your violation of these terms, misuse of our services, infringement of third-party rights, or breach of applicable laws.

Neither party shall be liable for failure or delay in performance caused by circumstances beyond their reasonable control, including but not limited to:

  • War, terrorism, civil unrest, or government actions
  • Power outages, telecommunications failures, or internet disruptions
  • Pandemics, epidemics, or public health emergencies
  • Labor disputes, strikes, or supplier failures

Severability and Interpretation

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed, and the remaining provisions shall remain in full force and effect.
